Trial Set For Sullivan Woman Charged In Fatal Crash

A February 2025 jury trial is set for a Sullivan woman accused of being intoxicated when she crashed into a vehicle and killed a woman.

Emily E. Hernandez is charged with DWI — death of another and DWI — serious physical injury.

The accident occurred Jan. 5, 2022 on Interstate 44.

Victoria Wilson was killed in the crash and her husband, Ryan, had serious injuries.

The Wilsons were returning to their St. Clair home from Sullivan where they had just celebrated their 15th wedding anniversary.

Hernandez was driving westbound in the eastbound lanes and struck the Wilsons vehicle on the passenger side.

Ryan Wilson had injuries to his hand, arm and right foot.

Hernandez appeared in court Feb. 26. Judge Ryan Helfrich scheduled a pre-trial conference on Oct. 1, 2024 and a jury trial to start Feb. 26, 2025.

Hernandez was indicted by a Franklin County jury in November 2022.

If found guilty, Hernandez faces up to 22 years in the Missouri Department of Corrections.

A wrongful death lawsuit was filed by the Wilson family and it was settled in 2022.

Judge Craig Hellmann approved the $125,000 settlement. Ryan Wilson received $70,000, their two children each received $15,000 and the Wilsons attorney received $25,000, according to the Washington Missourian.

Hernandez also served a 30-day sentence in federal prison for her role in the Jan. 6, 2021 riots in Washington, D.C. 

Hernandez was charged with entering and remaining in a restricted government building, disorderly conduct, demonstrating in the Capitol and stealing and disposing of government property.

She reached a plea deal with prosecutors on Jan. 10, 2022 and was sentenced that April.

Hernandez was captured holding a broken sign belonging to former House Speaker Nancy Pelosi.
